LEGAL NOTICE
NOTICE IS HEREBY GIVEN that at a Public Hearing will be held on August 19th, 2025 at 6:30 p.m. before the Town Board of the Town of Niagara, at the Town Hall, 7105 Lockport Road, Town of Niagara, New York in regards to:
1.whether to adopt a Local Law, ordinance or resolution authorizing the Town Assessor to grant exemptions to property owners, pursuant to New York State Real Property Tax Law §470, who meet national green building standards when construction building improvements and whether to establish a maximum exemption amount.
At such time and place all persons interested in the subject matter thereof will be heard concerning the same.

NOTICE OF ADOPTION OF AN AMENDING AND RESTATING BOND RESOLUTION, SUBJECT TO PERMISSIVE REFERENDUM AUTHORIZING A CAPITAL IMPROVEMENTS PROJECT CONSISTING OF THE RECONSTRUCTION OF AND CONSTRUCTION OF IMPROVEMENTS TO THE TOWN’S HIGHWAY GARAGE BUILDING
Notice is hereby given that at its June 17, 2025 meeting the Town Board of the Town of Niagara adopted a resolution that amends and restates a previously adopted bond resolution (dated May 20, 2025) for a capital improvements project consisting of the reconstruction of and construction of improvements to the Town’s Highway Garage Building, such work to generally consist of (but not be limited to) the repointing of an existing wall, as well as other such improvements as more fully identified in (or contemplated by) a report prepared by the Town, including all preliminary work and necessary equipment, materials and related site work, and any preliminary costs and other improvements and costs incidental thereto and in connection with the financing thereof (collectively, the “Purpose”); at an estimated maximum cost of $160,000. Such amended and restated bond resolution authorizes the issuance and sale of a serial bond or bonds and a bond anticipation note or notes in anticipation of the issuance and sale of such serial bonds, in an aggregate principal amount not to exceed $160,000, such amount to be offset by any federal, state, county and/or local funds received. The May 20, 2025 bond resolution was amended to correct a technical requirement related to the posting and publication of the notice of permissive referendum and make other determinations in connection therewith. Such amending and restating resolution is subject to permissive referendum pursuant to New York law.

NOTICE OF AMENDMENT AND RESTATEMENT OF BOND RESOLUTION TOWN OF NIAGARA
NOTICE IS HEREBY GIVEN that a resolution amending and restating prior bond resolution, a summary of which is published herewith, has been adopted by the Town Board of the Town of Niagara, Niagara County, New York (the “Town”), on June 17, 2025 and the validity of the obligations authorized by such resolution may be hereafter contested only if:
1. (a) such obligations were authorized for an object or purpose for which the Town is not authorized to expend money, or the provisions of the law which should be complied with as of the date of publication of this notice were not substantially complied with and an action, suit or proceeding contesting such validity is commenced within 20 days after the date of such publication of this notice, or
2. such obligations were authorized in violation of the provisions of the Constitution of New York.
SUMMARY OF RESOLUTION AMENDING
AND RESTATING A PRIOR BOND RESOLUTION
The following is a summary of an amending bond resolution adopted by the Town Board of the Town of Niagara on June 17, 2025, that amends and restates a bond resolution that was previously adopted by the Town Board on May 20, 2025. The proceeds from the sale of the obligations authorized under the bond resolution (as amended and restated) will be used for the purpose of financing a capital improvements project generally consisting of the reconstruction of and construction of improvements to various parking lots in the Town including, but not limited to, the reconstruction of the parking lot located at the Town Hall, highway garage, police department, and water department, as well as other such improvements as more fully identified in (or contemplated by) one or more reports prepared by the Town Highway Department, all of the forgoing to include all preliminary work and necessary equipment, materials and related site work, and any preliminary costs and costs incidental thereto and in connection with the financing thereof (collectively, the “Project”), at an estimated maximum amount of $450,000. Such amending and restating bond resolution authorizes the issuance and sale of a serial bond or bonds and a bond anticipation note or notes in anticipation of the issuance and sale of such serial bonds, in an aggregate principal amount not to exceed $450,000, such amount to be offset by any federal, state, county and/or local funds received. Such resolution was adopted subject to permissive referendum, and such permissive referendum period has elapsed without the filing of a petition. The Original Bond Resolution was amended and restated to correct a technical requirement related to the posting and publication of the notice of permissive referendum. The period of probable usefulness for such purpose is 10 years. A copy of the resolution amending and restating the prior bond resolution, as summarized herein, is available for public inspection during normal business hours at the Office of the Town Clerk, located in the Town Hall, 7105 Lockport Road, Niagara Falls, New York.

Richards Senior/Youth Activity Center in the Town (primarily Joe Rotella Way), such work to generally consist of (but not be limited to) milling and micro paving, as well as other such improvements as more fully identified in (or contemplated by) one or more reports prepared by the Town, all of the forgoing to include all preliminary work and necessary equipment, materials and related site work, and any preliminary costs and costs incidental thereto and in connection with the financing thereof (collectively, the “Purpose”); at an estimated maximum cost of $90,000. Such amended and restated bond resolution authorizes the issuance and sale of a serial bond or bonds and a bond anticipation note or notes in anticipation of the issuance and sale of such serial bonds, in an aggregate principal amount not to exceed $90,000, such amount to be offset by any federal, state, county and/or local funds received. The May 20, 2025 bond resolution was amended to correct a technical requirement related to the posting and publication of the notice of permissive referendum and make other determinations in connection therewith. Such amending and restating resolution is subject to permissive referendum pursuant to New York law.
