Niagara County District Attorney Brian D. Seaman announced David B. Fermoile, age 65, plead guilty this morning to murder in the second degree. Fermoile admitted to murdering his sister, Diane Fermoile-McAvoy, 68 years old, on June 7, 2023, in Lockport.
“There is no way to adequately express the devastation that this crime has had on the victim’s family. I do hope this plea will provide them some closure,” Seaman said.
Fermoile will be sentenced to 20 years to life in State Prison when he returns to be sentenced by County Court Judge Caroline Wojtaszek on Dec. 11.
The case was investigated by the Niagara County Sheriff’s Office and prosecuted by First Assistant District Attorney Doreen Hoffmann and Second Assistant District Attorney Peter Wydysh.
